Terms of sale

In force as of 5 October 2026.

1. Purpose

These terms of sale govern the sale of products offered on the XBZ Esport online shop. Any order implies full acceptance of these terms, which the customer acknowledges having read before placing the order.

The terms applicable are those in force on the date of the order.

2. Seller

Products are sold by XBZ E-SPORT, a non-profit association governed by the French law of 1 July 1901, registered in the French national register of associations under number W763022514 (SIREN 108 817 677 — SIRET of the registered office 108 817 677 00017 — intra-Community VAT number FR28 108 817 677), with registered office at 74 avenue Jean Jaurès, 3e étage, appartement 33, Iléa Verdé, 76140 Petit-Quevilly.

Contact: support@xbz-esport.com — phone: 06 72 42 19 20 — also reachable via the club's Discord.

3. Products

Products are described and presented as accurately as possible; their main characteristics appear on each product's page. Photographs are as faithful as possible but cannot guarantee a perfect likeness (colours, details). Products are offered while stocks last.

4. Personalisation

Some items can be personalised at the customer's request (name: up to 12 characters — Latin letters, spaces, hyphens, apostrophes, full stops —, printed in upper case; number from 0 to 99), for the surcharge shown on the product page. This option is only offered on the product pages that mention it. The printed text is the one shown in the preview before the item is added to the basket: the customer checks it before ordering.

The customer is responsible for the text they enter and guarantees that it does not infringe third-party rights (trademark, name, image) and is not offensive, defamatory, discriminatory or contrary to public order. XBZ E-SPORT may refuse to print a text that does not comply with these rules: it then informs the customer by email as soon as possible and offers another text or, at the customer's choice, cancellation of the personalised item and a full refund, surcharge included, no later than fourteen (14) days.

A personalised item is not covered by the right of withdrawal (Article L.221-28, 3° of the French Consumer Code); the other items in the order keep their right of withdrawal. The statutory guarantees (conformity, hidden defects) apply to all items: if the item delivered does not match the text entered, it is brought into conformity (repair or replacement) or, failing that, refunded, under the conditions of those guarantees.

5. Prices

Prices are shown in euros, all taxes included (VAT at the rate in force included), excluding delivery charges. These charges are shown in the cart before the order is confirmed. XBZ E-SPORT reserves the right to change its prices at any time; products are invoiced on the basis of the prices in force at the time of the order.

The price is payable in full, at once, when the order is placed.

6. Orders

The products are sold to consumers. The customer declares that they have the capacity to enter into a contract. A minor who has not been emancipated may only place an order with the consent of their legal representative (article 1146 of the French Civil Code), who then answers for payment and for any exercise of the right of withdrawal. Failing that, XBZ E-SPORT may cancel the order and refund the payment in full.

The order is definitively confirmed once payment is confirmed. A payment receipt is sent by Stripe, and an order confirmation email by XBZ E-SPORT, to the address the customer gave when paying. An invoice can be obtained on request at support@xbz-esport.com.

Each order is archived electronically and kept for ten (10) years. The customer may obtain a copy at any time on request at support@xbz-esport.com, from the address used for the order.

XBZ E-SPORT reserves the right to cancel any order in the event of non-payment, a product being out of stock, delivery to the address given being impossible, or proven fraud; the customer is informed and, if already charged, fully refunded as soon as possible and no later than fourteen (14) days.

7. Payment

Payment is made online by bank card, through the secure Stripe platform. No card details are entered or stored by XBZ Esport: payment is processed directly by Stripe. The order is recorded only after Stripe confirms payment.

8. Delivery

Products are delivered to the address given at the time of the order. XBZ E-SPORT undertakes to deliver them no later than 10 working days after payment is confirmed. Delivery charges are shown before the order is confirmed. Delivery is available to metropolitan France, Monaco, Belgium, Luxembourg, Switzerland, Germany, Spain, Italy, the Netherlands and Portugal.

Switzerland is not part of the European Union: customs duties, taxes or import fees may be charged on delivery by the authorities or the carrier. They are borne by the customer and are not included in the price.

In the event of delay, the customer is informed as soon as possible. If the products are not delivered within the stated time, the customer may terminate the contract under Article L.216-2 of the French Consumer Code: by registered letter with acknowledgement of receipt or by another written durable medium, after having called on XBZ E-SPORT to deliver within an additional reasonable period and if delivery has not taken place within that period; or immediately if XBZ E-SPORT refuses to deliver, or if the delivery date was an essential condition of the contract for the customer. XBZ E-SPORT then refunds all sums paid no later than fourteen (14) days after termination (Article L.216-3 of the French Consumer Code).

Risk passes to the customer when they physically take possession of the products (Article L.216-4 of the French Consumer Code). If a parcel is damaged, the customer is asked to note their reservations with the carrier on delivery and to inform XBZ E-SPORT at support@xbz-esport.com.

9. Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the customer has fourteen (14) days from receipt of the products to exercise their right of withdrawal, without giving any reason or paying a penalty.

To exercise it, the customer informs XBZ E-SPORT of their decision by an unambiguous statement: online, with the “Withdraw from contract here” function available at any time from the footer of every page of the site and from the order confirmation page (the customer gives their full name, their email address and the details needed to identify their order, then confirms; an acknowledgement of receipt showing the content of their statement and the date and time it was sent is emailed to them); or by postal letter to 74 avenue Jean Jaurès, 3e étage, appartement 33, Iléa Verdé, 76140 Petit-Quevilly or by email to support@xbz-esport.com; the model form below may be used. The statement must be sent before the deadline.

The customer returns the products without undue delay, and no later than fourteen (14) days after communicating their decision, to the following address: 74 avenue Jean Jaurès, 3e étage, appartement 33, Iléa Verdé, 76140 Petit-Quevilly. The customer is invited to return the products in packaging that protects them during transport, preferably in their original packaging, with their accessories and tags. Return costs are borne by the customer. The customer is only liable for any loss in value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

If the withdrawal covers the whole order, XBZ E-SPORT refunds all payments received, including the initial delivery costs (standard delivery), no later than fourteen (14) days after being informed of the decision to withdraw. If it covers only some of the items, XBZ E-SPORT refunds the price of those items within the same period; the initial delivery costs are not refunded, as they remain due for the items kept. The refund may be withheld until the products have been recovered or until the customer provides proof of having sent them back, whichever is earlier. It is made using the same means of payment as the one used for the order.

In accordance with Article L.221-28, 3° of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the customer's specifications or clearly personalised, for example a jersey bearing the name and/or number chosen by the customer. Where an order includes both personalised and ordinary items, the right of withdrawal remains exercisable for the ordinary items. See the "Personalisation" article.

To XBZ E-SPORT, 74 avenue Jean Jaurès, 3e étage, appartement 33, Iléa Verdé, 76140 Petit-Quevilly, support@xbz-esport.com: I hereby give notice of my withdrawal from the contract for the order below: — Ordered on [date] / received on [date] — Order number: [number] — Customer name: [name] — Customer address: [address] — Date: [date] — Signature (only if notified on paper):

10. Legal guarantees

All products benefit from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code), independently of any commercial guarantee. How these legal guarantees are implemented is set out in the box below.

To make use of these guarantees, the customer contacts XBZ E-SPORT by email at support@xbz-esport.com, by phone on 06 72 42 19 20 or by post at 74 avenue Jean Jaurès, 3e étage, appartement 33, Iléa Verdé, 76140 Petit-Quevilly.

If the goods cannot be brought into conformity where they are, and they can be returned by post without major inconvenience to the customer or costs disproportionate to their value, the customer sends them by post to the following address: 74 avenue Jean Jaurès, 3e étage, appartement 33, Iléa Verdé, 76140 Petit-Quevilly. Postage is borne by XBZ E-SPORT, repair or replacement being free of charge for the customer. Otherwise, XBZ E-SPORT tells the customer the practical arrangements for collecting the goods, at no cost to them. The customer cannot be required to arrange or pay for any transport other than a postal shipment.

Reminder of the legal guarantees

The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to establish that the lack of conformity exists, not the date on which it appeared. Where the sales contract for the goods provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer is only required to establish that the lack of conformity affecting the digital content or digital service exists, not the date on which it appeared. The legal guarantee of conformity obliges the professional, where applicable, to supply all updates necessary to maintain the conformity of the goods. The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them. If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee. If the consumer asks for the goods to be repaired but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods. The consumer may obtain a reduction of the purchase price while keeping the goods, or end the contract and be fully refunded against return of the goods, if: 1° The professional refuses to repair or replace the goods; 2° The repair or replacement of the goods takes place after a period of thirty days; 3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of collecting or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods; 4° The lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity. The consumer is also entitled to a reduction of the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to ask for repair or replacement of the goods beforehand. The consumer is not entitled to termination of the sale if the lack of conformity is minor. Any period during which the goods are immobilised for repair or replacement suspends the guarantee that remained to run until the repaired goods are delivered back. The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code. A seller who in bad faith obstructs the implementation of the legal guarantee of conformity incurs a civil fine of up to EUR 300,000, which may be raised up to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code). The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

11. Liability

XBZ E-SPORT cannot be held liable for failure to perform the contract where it results from the customer's own act, from force majeure within the meaning of Article 1218 of the French Civil Code, or from the unforeseeable and unavoidable act of a third party unconnected with the supply of the products. If an item turns out to be out of stock after the order, the customer is informed and refunded. These provisions do not limit the customer's statutory rights.

12. Personal data

The data collected when placing an order is necessary for its processing and delivery. It is handled by XBZ E-SPORT in accordance with our privacy policy.

See the privacy policy

13. Applicable law and disputes

These terms are governed by French law, without prejudice to the mandatory consumer-protection provisions of the law of the country where the customer habitually resides.

In the event of a difficulty, the customer is invited to first contact XBZ E-SPORT in writing at support@xbz-esport.com, which will endeavour to find an amicable solution. Failing a satisfactory reply, the customer may use a consumer mediator free of charge: CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, https://www.cm2c.net, contact@cm2c.net, 01 89 47 00 14.

Failing an amicable settlement, the French courts have jurisdiction, without prejudice to the jurisdiction rules that protect consumers.
